These Terms of Service (the “Terms”) govern your use of indiekbeauty Creators (the “Platform”), operated by Beauty Bridge Inc (“we,” “us,” or “our”). By signing in to the Platform you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Platform.
You must be at least 18 years old, live in the United States, and hold a TikTok account in good standing that complies with TikTok’s Terms of Service and Community Guidelines. You may hold only one creator account unless we agree otherwise in writing.
You sign in using TikTok Login Kit. You are responsible for keeping your TikTok account secure and for all activity that occurs under your creator account. Tell us promptly at support@b2beautie.com if you believe your account has been compromised.
Because TikTok does not share your contact details with us, you agree to provide accurate contact and shipping information and to keep it current. Products sent to an address you gave us incorrectly are your responsibility.
Taking part in any campaign is voluntary for you and discretionary for us. The specific terms of each campaign — the products involved, deliverables, commission rate, payment schedule, and campaign period — are communicated to you separately and form part of these Terms for that campaign. Where a campaign term conflicts with these Terms, the campaign term controls for that campaign.
Commission is earned only on qualifying sales as defined in the campaign terms. We may withhold or reverse commission on orders that are cancelled, returned, refunded, or that we reasonably determine to be fraudulent or the result of prohibited conduct. You are responsible for your own taxes on any amounts you receive, and we may require tax documentation before paying you.
Seeding campaigns are gifted collaborations: the product is your only compensation, and no payment is made unless the campaign terms say otherwise. Products provided for seeding are given to you for personal evaluation and content creation. Unless we state otherwise in writing, they are not for resale and may not be listed on any marketplace. Title passes to you on delivery; we make no warranty beyond what the manufacturer provides and what applicable law requires.
When you accept products under a seeding campaign, you agree to the following, unless the campaign terms set different deadlines or periods:
We confirm these obligations by reviewing the public videos of your connected account, as described in our Privacy Policy. If you disconnect your account during this time, we may be unable to confirm your post and may treat it as not made. If a campaign post is not made, or is removed or made private early, we may decline to include you in future campaigns. If something prevents you from posting on time — for example, the product arrived damaged — tell us at support@b2beautie.com before the deadline.
When you post content about products you received from us, or content that earns you commission, you must clearly and conspicuously disclose that relationship. This is required by the U.S. Federal Trade Commission’s Endorsement Guides and by TikTok’s branded content policy. At minimum you must:
You may not make claims about a product that we have not provided or approved, including claims that a product treats, cures, or prevents any disease.
You keep ownership of the content you create. By posting content about our products or brands under a campaign, you grant us, and the brand whose product the campaign features, a non-exclusive, worldwide, royalty-free licence to reshare that content on our and that brand’s marketing channels and retail listings for the duration of the campaign and for twelve months afterwards, with attribution to your TikTok handle. Neither we nor the brand will modify your content in a way that changes its meaning. You may ask us to stop using a specific piece of content by writing to support@b2beautie.com, and we will do so within a reasonable time.
You may stop using the Platform at any time and ask us to close your account. We may suspend or close an account that breaches these Terms, TikTok’s policies, or applicable law, or where we reasonably suspect fraud. Where circumstances allow, we will tell you why. Commission already earned on qualifying sales remains payable unless it was earned through the conduct that led to termination.
The Platform is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Platform will be uninterrupted or error-free, that you will be selected for any campaign, or that you will earn any particular amount.
To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or lost opportunities. Our total liability arising out of or relating to the Platform will not exceed the greater of the total commission we paid you in the twelve months before the event giving rise to the claim, or one hundred U.S. dollars (US$100). Nothing in these Terms limits liability that cannot be limited by law.
You agree to indemnify and hold us harmless from claims and costs arising out of your content, your failure to make required disclosures, or your breach of these Terms or applicable law.
You take part as an independent contractor. Nothing in these Terms creates an employment, partnership, joint venture, or agency relationship between you and us, and you may not hold yourself out as able to bind us.
We may update these Terms from time to time. We will revise the effective date at the top of this page, and for material changes we will notify you by email or through the Platform before the change takes effect. Continuing to use the Platform after a change takes effect means you accept the updated Terms.
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. The state and federal courts located in Los Angeles County, California will have exclusive jurisdiction over any dispute, and you and we consent to that jurisdiction.
